Can my assessment go up if I appeal?

It depends on the state. In Texas and New York there is no risk of an increase. In Ohio, Connecticut, New Jersey, and Virginia, an increase is legally possible but uncommon in practice. FairAppeal reviews your property carefully before filing and will not file, or will withdraw, if we identify a meaningful risk.

It depends on the state. Here’s what the law says in each state where we operate.

Texas: No risk. Texas law does not permit your value to be increased during the protest process without your consent.

New York: No risk. New York law does not permit an assessment to be increased simply because a grievance was filed.

Ohio: Some risk, though increases are uncommon in practice. The Board of Revision has the authority to adjust a property’s value in either direction. We minimize that risk by reviewing comparable sales, sale history, and assessment position before filing and again before any hearing. If we identify a meaningful risk of an increase, we will not file or will withdraw the appeal.

Connecticut: Some risk, though increases are uncommon in practice. The Board of Assessment Appeals has the authority to increase, decrease, or make no change to an assessment. We minimize that risk by evaluating property data and recent sales before filing and again before the hearing. If we identify a meaningful risk of an increase, we will not file or will withdraw the appeal.

New Jersey: Some risk, though increases are uncommon in practice. A tax appeal can result in a higher assessment if the evidence supports it. We minimize that risk by screening each property carefully before filing and reassessing the data before the hearing. If we identify a meaningful risk of an increase, we will not file or will withdraw the appeal.

Virginia: Some risk, though increases are uncommon in practice. The Board of Equalization has the authority to increase, decrease, or affirm a property’s assessed value. We minimize that risk by reviewing assessment data and market evidence before filing and again before the hearing. If we identify a meaningful risk of an increase, we will not file or will withdraw the appeal.
