Welcome to FairAppeal

These Terms of Service ("Terms") govern your use of FairAppeal's property tax appeal services. By using our services, you agree to these Terms. Please read them carefully.

FairAppeal provides property tax appeal services to help homeowners reduce their property tax burden. We handle the entire appeal process on your behalf, and you only pay if we successfully reduce your taxes.

Our Services

FairAppeal provides the following services:

  • Free Property Tax Analysis: We analyze over 200 data points to determine if your property is over-assessed and calculate your potential savings
  • Appeal Filing: We prepare and file formal property tax appeals with your county tax assessor on your behalf
  • Representation: We represent your interests in negotiations and hearings with tax authorities
  • Case Management: We handle all paperwork, deadlines, and communications throughout the appeal process
  • Updates and Support: We keep you informed about your appeal status and answer any questions you may have

Fees and Payment

You Only Pay If We Win

Our success fee is 25% of your first year's tax savings. If we don't reduce your taxes, you pay nothing.

Fee Structure Details

  • No Upfront Costs: There are no fees to get started or for the initial property analysis
  • Success-Based Fee: If we successfully reduce your property taxes, our fee is 25% of your first year's tax savings
  • Future Savings Are Yours: You keep 100% of the tax savings in all subsequent years. The 25% fee only applies to the first year
  • No Hidden Fees: The 25% success fee is our only charge. There are no additional, hidden, or surprise fees
  • Payment Timing: Payment is due only after your appeal is successful and your new (reduced) tax assessment is confirmed

Example: If we reduce your annual property taxes from $5,000 to $3,000, you save $2,000 per year. Our fee would be $500 (25% of $2,000) in the first year only. You would keep the full $2,000 savings every year thereafter.

Your Responsibilities

To provide the best possible service, we need your cooperation. When you use FairAppeal, you agree to:

  • Provide Accurate Information: Supply complete and accurate information about your property and tax assessment
  • Grant Authorization: Authorize FairAppeal to represent you before tax authorities and access your property tax records
  • Respond Promptly: Reply to our requests for information or documentation in a timely manner
  • Review Communications: Read and respond to updates about your appeal status
  • Pay Success Fees: Pay our success fee promptly after a successful appeal outcome
  • Property Eligibility: Ensure your property is eligible for appeal (e.g., you are the legal owner or authorized representative)

Service Guarantees and Limitations

What We Guarantee

  • We will conduct a thorough analysis of your property using over 200 data points
  • We will file appeals before all applicable deadlines
  • We will use our best efforts to reduce your property taxes
  • We will keep you informed throughout the process
  • You will only pay if we successfully reduce your taxes

Important Limitations

While we have a 91% success rate, we cannot guarantee a specific outcome for your appeal. Tax assessment decisions are ultimately made by county tax authorities.

What We Don't Guarantee

  • A specific reduction amount or percentage in your property taxes
  • A successful appeal outcome (though we strive for the best result)
  • That the county assessor will agree with our analysis or recommendations
  • Specific timelines, as appeal processing times vary by county

Cancellation and Termination

Your Right to Cancel

You may cancel our services at any time by contacting us at hello@fairappeal.com. Please note:

  • If you cancel before we file your appeal, there is no fee
  • If you cancel after we've filed your appeal but before it's resolved, you may still owe our success fee if the appeal is ultimately successful
  • Once an appeal is successfully completed and your taxes are reduced, the success fee is due regardless of subsequent cancellation

Our Right to Terminate

We reserve the right to terminate our services if:

  • You provide false or misleading information
  • You fail to respond to our communications for an extended period
  • You refuse to pay fees owed for successful appeals
  • You violate these Terms of Service
  • We determine your property is ineligible for appeal or unlikely to benefit from our services

Intellectual Property

All content, technology, and materials on our website and in our services, including but not limited to text, graphics, logos, analysis methodologies, and software, are the property of FairAppeal and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

Limitation of Liability

To the fullest extent permitted by law, FairAppeal shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
  • Decisions made by county tax assessors or other government authorities
  • Delays in appeal processing caused by government agencies
  • Errors or omissions in data provided by third-party sources
  • Any damages exceeding the fees you paid to FairAppeal in the 12 months preceding the claim

We provide our services "as is" and make no warranties, express or implied, regarding the services or their outcomes.

Dispute Resolution

If you have a concern or dispute with FairAppeal, please contact us first at hello@fairappeal.com. We are committed to resolving issues amicably and promptly.

If we cannot resolve a dispute through informal means, any legal action or proceeding arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

General Provisions

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FairAppeal regarding our services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
